1. Acceptance of Terms

By accessing or using QuikEvents ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

QuikEvents provides an online platform for event organizers to create, promote, and sell tickets to events, and for users to discover and purchase tickets to events. The Service includes:

• Event creation and management tools
• Ticketing and registration services
• Payment processing
• Event discovery and promotion
• Venue booking services (Quik Venues)
• Analytics and reporting tools

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify QuikEvents immediately of any unauthorized access to or use of your account.

4. Event Organizers

4.1 Organizer Responsibilities

As an event organizer, you agree to:

• Provide accurate and complete information about your events
• Honor all ticket sales and fulfill your obligations to attendees
• Comply with all applicable laws and regulations
• Not use the Service for any illegal or unauthorized purpose
• Handle refunds and disputes in good faith

4.2 Content Standards

You agree that all content you post will not contain material that is offensive, defamatory, infringing, or otherwise inappropriate. QuikEvents reserves the right to remove any content that violates these standards.

5. Ticket Purchases

5.1 Purchase Terms

When you purchase tickets through QuikEvents, you are entering into a contract with the event organizer. QuikEvents acts as an intermediary and is not responsible for the event itself.

5.2 Fees

Ticket prices are set by event organizers. QuikEvents charges service fees which include:

• Platform processing fee: 7% of ticket price
• Payment processing fee: 2.9% + $0.30 per transaction

These fees are clearly displayed before you complete your purchase.

5.3 Refunds and Cancellations

Refund policies are set by individual event organizers. QuikEvents service fees are generally non-refundable unless the event is canceled and not rescheduled.

6. Venue Services

For events using Quik Venues, additional terms apply:

• Venue bookings are subject to availability and venue-specific terms
• Deposits and payments for venues are processed separately from ticket sales
• Cancellation policies vary by venue and are clearly stated during booking

7. Prohibited Uses

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Attempt to interfere with or disrupt the Service
• Use automated systems or software to extract data from the Service
• Impersonate or attempt to impersonate another user or person
• Sell, resell, or transfer your account

8. Intellectual Property

The Service and its original content, features, and functionality are owned by QuikEvents and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

QuikEvents is not responsible for:

• The actions or inactions of event organizers
• The quality, safety, or legality of events listed
• The accuracy of event information provided by organizers
• Any disputes between users and event organizers

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIKEVENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to defend, indemnify, and hold harmless QuikEvents and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Service.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

15. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
